Major Published Appellate Victories Changing the Law and Benefiting Trial Lawyers and Association of Trial Lawyers In Subsequent Cases Across the Country

Trial Lawyers and Trial Lawyers Associations have benefitted widely from the significant victories that Henke has acheived, not just as a trial lawyer but by virtue of his appellate victories.

As the result, these appellate accomplishments have benefitted Mr. Henke's clients and the clients of may other trial lawyers

However, appellate victories are an important measure of the trial lawyers ability to make

the most effective legal arguments at every stage of litigation, improving the client's settlement position before trial, overcoming evidentiary hurdles during trial, obtaining strategic advantages in trial and then preserving the favorable judgment on post trial motions and appeal.

Examples of Mr. Henke's Extraordinary Published Appellate Victories Oft Cited by Trial Lawyers and Trial Lawyers Association:

Lawyer Henke prosecuted important pre-trial appeal from a trial court decision applying "tort reform" legislation to deny his client's rights to pursue punitive damages at trial. Attorney Henke obtained a stay of the trial, persuaded the appellate court to intervene on an "extraordinary writ," overturn the trial court's decision and change the law, essentially removing the teeth from the tort reform law. James Looney v. Superior Court, 16 Cal.App.4th 521 (1993)[reh. den. July 10, 1993][rev. den. September 2, 1993]

On behalf of a single client lawyer Henke filed another "petition for writ of mandamus" from an Ohio Federal District Court's certification of a "mandatory class action" and Court approved $120,000,000 brokered settlement purporting to bind 1000 product liability claimants in Ohio and all others nationwide. Mr. Henke argued on appeal to the United States Court of Appeals for the Sixth Circuit that the District Court's class certification and settlement impaired his single client's right to choice of the trial attorney of his preference and control over his individual litigation. The United States Court of Appeals agreed with lawyer Henke's position, overturned the Federal District Court's order certifying the class, and voided the $120,000,000 settlement. In re Bendectin, 749 F.2d 300 (6th Cir. 1985).

The last cited appellate opinion was discussed in Henke, "Mandatory Class Action," published, in "Trial" the monthly journal of the Association of Trial Lawyers of America.
