First we feel that it is important for you to consider that every E coli case arising out of the August-September E. coli outbreak is properly filed in California regardless of the state in which the spinach was ingested and injury suffered because the primary defendants in all the litigation are California companies. It was in the State of California where the spinach was grown and it was a California distributor, Natural Selection Foods, LLC, of San Juan Bautista, California, through which it appears that all of the contaminated spinach made its way into the chain of commerce. Indeed, all secondary distributors who have voluntarily recalled their products have done so because their products were comprised in whole or part of spinach which they concluded was or might have been obtained from this one California distributor.

The Centers for Disease Control has conducted the investigation of all reported E. coli cases in the United States resulting from this August/September, 2006 E. coli outbreak and has concluded that all of the involved spinach resulting in illness from E. coli contamination during this period originated from contaminated spinach grown in three California counties.

“FDA is working closely with CDC and the state of California. FDA has determined that the spinach implicated in the outbreak was grown in three counties: Monterey, San Benito and Santa Clara in California. Spinach grown in the rest of the United States has not been implicated in the current E. coli O157:H7 outbreak. The public can be confident that spinach grown in the non-implicated areas can be consumed.”

In addition to the fact that all of the contaminated spinach was grown in California it appears from the current FDA statement that the principle distributor of the contaminated spinach was Natural Selection Foods, LLC, of San Juan Bautista, California. Other secondary distributors have stated that they obtained the spinach which they packaged and redistributed originated from the California Natural Selections Foods distributor.

Therefore California jurisdiction is proper, the primary defendants are located in California, all the E. Coli cases arising from ingestion of the California grown spinach in any state may properly be filed in the State of California. Furthermore, there are substantial advantages to filing the cases in California, including advantages of California law and that all of the most important “discovery” will need to be accomplished here in California, including the depositions of those growers responsible for the E. Coli contamination, essential for the competent prosecution of the cases, among other advantages discussed below.

Coli, The Symptoms of Ecoli, its Diagnosis and Treatment, the Symptoms of Hemolytic Uremic Syndrome (HUS), its Diagnosis, its Complications, Prognosis and Treatment.

E. Coli and HUS, Their Symptoms, Diagnosis, Complications, and Prognosis.

Escherichia coli, which we have referred to above by its common name E. coli, is a general class of common bacteria. There hundreds of strains of the E coli bacterium. E coli exists in the lower digestive tract of humans and all mammals. E coli serve an essential purpose in digestion and are indeed essential for our survival.

It is a particular strain of E coli which causes the toxin which can lead to human illness, and sometimes devastating diseases, Hemolytic Uremic Syndrome, leading to kidney failure, and Thrombotic Thrombocytopenic Purpura, which can result in severe neurological side effects, including strokes

This deadly strain is called E. coli O157:H7. The letters and numbers distinguish it from other types of E coli, and refer to the strain's surface genetic markers.

There are many food products that can be infected with this deadly strain of E coli, including undercooked ground beef, salami, unpasteurized milk or juice, as well as vegetable products such as lettuce, sprouts, and as we see here in the most recent outbreak, spinach. E coli O157:H7 can also be contracted through contact with human contact.

The most common symptoms of Ecoli O157:H7 infection are relatively mild and include hemorrhagic colitis, characterized by bloody stools, abdominal pain and severe cramps; in some cases fever may be present or it may not. Symptoms usually develop within 3 to 4 days of ingesting the contaminated food and resolve within 5 to 10 days.

Less commonly O157:H7 infection results in more severe syndromes and diseases including HUS, Hemolytic Uremic Syndrome, and TTP, Thrombotic Thrombocytopenic Purpura.

Hemolytic Uremic Syndrome (HUS) resulting from E. coli O157:H7 poisoning commonly occurs after bloody diarrhea and can cause acute renal failure. Many who suffer renal failure will require kidney dialisis treatment for life. Sometimes those who suffer HUS related acute renal failure will not survive.

Thrombotic Thrombocytopenic Purpura (TTP) is similar to HUS except that those whose E. Coli infection results in TTP may also suffer neurological side effects, headaches, behavioral or mood changes, or in some cases strokes.

The Characteristics of the Outbreak of E Coli and HUS from Ingestion of California Spinach

The following information was obtained from the Centers for Disease Control on September 24, 2006, and unfortunately the numbers of those infected, whose diseases progress to more serious illness, and those who die may rise. While the illnesses occurred in August and early September, the reason the numbers may change is due mostly to delays in reporting the illnesses and then the necessity for the CDC to confirm them.

As of September 24, 2006, 173 persons infected with the outbreak strain of E. coli O157:H7 had been reported to CDC from 25 states.

Among the ill persons, 92 (53%) were hospitalized, 28 (16%) developed hemolytic-uremic syndrome (HUS), and an adult in Wisconsin died. One hundred twenty-five (72%) were female and 15 (9%) were children under 5 years old. The proportion of persons who developed HUS was 29% in children (<18 years old), 8% in persons 18 to 59 years old, and 16% in persons 60 years old or older. Among ill persons who provided the date when their illnesses began, 88% became ill between August 19 and September 5. The peak time when illnesses began was August 30 to September 1 -- 35% of persons with the outbreak strain became ill on one of those 3 days.

The CDC Has Confirmed that the Spinach Responsible for this E Coli Outbreak was Grown in Three California Counties; All Spinach Grown Elsewhere CDC Confirms is Not Infected.

It was confirmed by the CDC that this August - September 2006 E. Coli outbreak resulting from exposure to contaminated spinach originated from spinach grown in three California counties, Monterey County, San Benito County and Santa Clara County. The CDC concluded that spinach grown outside those three counties was safe.

Having isolated the specific counties in which the E coli outbreak originated CDC is advising: "Fresh spinach grown outside these counties can be safely eaten. If consumers cannot verify that fresh spinach was grown in areas other than the California counties of Monterey, San Benito and Santa Clara, they are advised not to purchase or consume the fresh spinach."

The spinach grown in these California counties has been distributed throughout the United States and cases of E coli poisoning associated with this outbreak have been discovered thus far in 25 states: Arizona, California, Colorado, Connecticut, Idaho, Illinois, Indiana, Kentucky, Maine, Michigan, Minnesota, Nebraska, Nevada, New Mexico, New York, Ohio, Oregon, Pennsylvania, Utah, Virginia, Washington, Wisconsin, and Wyoming.

Anyone in any state of the United States who has eaten spinach and developed any of the symptoms identified above should contact their physician and specifically ask that he or she be given the appropriate tests to determine whether their symptoms are associated with E coli infection.

The Principle Distributor of the E. coli Contaminated Spinach was Natural Selection Foods, LLC, of San Juan Bautista, California; All Other Distributors Who Have Recalled Their Products From the Market Are Distributors Who Received Spinach from Natural Selection Foods of California. The Brands of the Spinach and Spinach Products Are Listed by Distributor.

According to the FDA the following are a list of brands of spinach and products containing spinach which have been recalled from the market as the result of the E coli outbreak, and the distributors which have withdrawn them.

All those distributors who have thus far voluntarily recalled their products have done so because they distributed products that were comprised of spinach which was distributed by Natural Selection Foods of California or because their products may have contained spinach which was distributed to them by Natural Foods of California.

On September 15, 2006, Natural Selection Foods, LLC, of San Juan Bautista, California, announced a voluntary recall of all products containing spinach in all brands they pack with "Best if Used by Dates" of August 17, 2006 through October 1, 2006. These products include spinach and any salad with spinach in a blend, both retail and food service products. Products that do not contain spinach are not part of this recall.

Natural Selection Foods, LLC brands include: Natural Selection Foods, Pride of San Juan, Earthbound Farm, Bellissima, Dole, Rave Spinach, Emeril, Sysco, O Organic, Fresh Point, River Ranch, Superior, Nature's Basket, Pro-Mark, Compliments, Trader Joe's, Ready Pac, Jansal Valley, Cheney Brothers, D'Arrigo Brothers, Green Harvest, Mann, Mills Family Farm, Premium Fresh, Snoboy, The Farmer's Market, Tanimura & Antle, President's Choice, Cross Valley, and Riverside Farms.

On September 17, 2006, River Ranch, of Salinas, California, announced a voluntary recall of packages of spring mix containing spinach. River Ranch obtained bulk spring mix containing spinach from Natural Selections. The following brands are involved: Fresh N' Easy Spring Mix and Hy-Vee Spring mix containing baby spinach, distributed to retailers in Texas, Iowa, New Mexico, Georgia and Ohio. Product was packed in 5 oz. bags and 5 oz. plastic trays. Products that do not contain spinach are not part of this recall.

On September 19, 2006, RLB Food Distributors, L.P. initiated a voluntary recall of certain salad products that may contain spinach with an Enjoy Thru date of 9/20/06. The products recalled by RLB are: Balducci's Mesclun Mix 5 oz., Balducci's Organic Baby Spinach 5 oz., Balducci's Mixed Greens 5 oz., FreshPro Mesclun Mix 5 oz., FreshPro Organic Baby Spinach 5 oz., FreshPro Mixed Greens 5 oz., FreshPro Salad Mix with Italian Dressing 4.75 oz., and FreshPro Salad Mix with Ranch Dressing 5.25 oz .

According to the RLB Food Distributors press release: “Spinach used in these products may have been supplied from Natural Selections Foods, a California grower and processor, to RLB Food Distributors. This recall was initiated when Natural Selections Foods issued on 9/15/06 a nation-wide recall of all their products that contain spinach because they may be contaminated with Escherichia coli 0157:H7 bacteria (E. coli).”

On September 22, 2006, Pacific Coast Fruit Company of Portland, Oregon initiated a voluntary recall of products that may include spinach supplied by Natural Selections Foods.Pacific Coast Fruit Company stopped making all products with spinach supplied from California on September 14, 2006. Most of the salad products can be identified by the labels Trader Joe's, My Brothers Pizza or Chef on the Run and are in clam shell containers. Pizza products are in round cardboard bottoms with a plastic over wrap. All salad products will have a "USE BY DATE" on or before Sept 20, 2006. Pizza products will have a "USE BY DATE" on or before September 23, 2006. The products were distributed through various retail outlets in Alaska, Oregon, Washington and Idaho.
